Daphne S. Withrow Serves as Co-Counsel on Landmark $60 Million Medical Malpractice Case

Daphne S. Withrow, RN, — an accomplished attorney, nurse and partner at Olivetti, McCray & Withrow, LLC — recently served as co-counsel on a landmark $60million medical malpractice verdict in Cobb County State Court in Marietta, Georgia.   

On Dec. 18, 2018, a Cobb County jury returned a unanimous $60 million verdict in a tragic case involving April Jenkins, a 37-year-old woman who died in 2013, following a liposuction procedure performed by Dr. Nedra Dodds at Opulence Aesthetic Medicine in Kennesaw, Ga.

“This is an egregious case of medical malpractice,” said Withrow. “Unfortunately, there’s little to no regulation or oversight for these types of surgery centers, which allows them to proliferate and to operate without proper accreditation or board-certified plastic surgeons.”

Withrow originally began working on the case in 2013 while an associate attorney at Savage, Turner, Durham, Pinckney & Savage in Savannah, Ga.

“As a nurse, this case made me sick,” said Withrow. “This verdict shines a spotlight on how dangerous these ‘strip-mall’ surgery centers can be. This isn’t just a problem in Georgia. It’s a national issue.”

Withrow advises anyone who is considering cosmetic surgery to conduct research in advance.

“Do your homework,” she said. “Research your doctor to make sure he or she is a board-certified plastic surgeon and confirm that your procedure will take place in an accredited surgical center.”

Withrow has the distinction of being one of only a handful of plaintiff’s attorneys in the region who is also a licensed Registered Nurse. She spent over 30 years working in the medical field before attending law school and becoming an attorney.
